  1.   1. Personal data means any information relating to an identified or identifiable natural person. An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, online identifier, or one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.

II. Sources and Categories of Processed Personal Data

  1. The controller processes personal data that you have provided or personal data the controller has obtained based on the fulfilment of your order.

  2. The controller processes your identification and contact details and data necessary for the performance of the contract.


III. Legal Grounds and Purpose of Processing Personal Data

  1. The legal grounds for processing personal data are:

  • Performance of a contract between you and the controller under Article 6(1)(b) GDPR,

  • The legitimate interest of the controller in providing direct marketing (especially for sending commercial messages and newsletters) under Article 6(1)(f) GDPR,

  • Your consent to processing for the purpose of direct marketing (especially for sending commercial messages and newsletters) under Article 6(1)(a) GDPR in connection with Section 7(2) of Act No. 480/2004 Coll., on certain information society services, if no order of goods or services has taken place.

  1. The purpose of processing personal data is:

  • To process your order and exercise rights and obligations arising from the contractual relationship between you and the controller. When placing an order, personal data required for successful order fulfillment are necessary (name, address, contact details); providing personal data is a necessary requirement for concluding and performing the contract. Without providing personal data, it is not possible to conclude or fulfil the contract.

  • Sending commercial communications and performing other marketing activities.

  1. The controller does / does not engage in automated individual decision-making within the meaning of Article 22 GDPR. You have given your explicit consent for such processing.


IV. Retention Period of Personal Data

  1. The controller retains personal data:

  • For the period necessary to exercise rights and obligations arising from the contractual relationship between you and the controller and to assert claims arising from such relationships (for 15 years after termination of the contractual relationship).

  • For the period until consent to processing for marketing purposes is revoked, for a maximum of … years, if the data are processed based on consent.

V. Recipients of Personal Data (Controller’s Subcontractors)

  • Involved in delivering goods/services or processing payments under a contract,

  • Providing services related to e-shop operation (Shoptet) and other related services,

  • Providing marketing services.

  1. The controller does / does not intend to transfer personal data to a third country (a country outside the EU) or an international organisation. Recipients of personal data in third countries include providers of mailing services / cloud services.


VI. Your Rights

  1. Under the conditions set out in the GDPR, you have:

  • The right of access to your personal data under Article 15 GDPR,

  • The right to rectification under Article 16 GDPR or restriction of processing under Article 18 GDPR,

  • The right to erasure under Article 17 GDPR,

  • The right to object to processing under Article 21 GDPR,

  • The right to data portability under Article 20 GDPR,

  • The right to withdraw consent to processing in writing or electronically to the controller’s address or email stated in Article III of these terms.

  1. You also have the right to lodge a complaint with the Office for Personal Data Protection if you believe that your data protection rights have been violated.


VII. Conditions for Securing Personal Data

  1. The controller states that it has taken all appropriate technical and organisational measures to secure personal data.

VIII. Final Provisions

  1. By sending an order through the online order form, you confirm that you are familiar with the Privacy Policy and that you accept it in full.

  2. You agree to these terms by ticking the consent checkbox in the online form. By ticking the checkbox, you confirm that you are familiar with the Privacy Policy and that you accept it in full.

  3. The controller is entitled to amend these terms. The new version of the Privacy Policy will be published on the controller’s website and sent to your email address that you have provided to the controller.
